Indonesian Public Holiday 2023

As we all know, every year we always take note of the Public Holiday schedule. Whether to schedule our leave accordingly or just to take time off. Indonesia’s employment law governed Public Holiday where employees are not obliged to perform work based on Article 85 of Law 13/2003 concerning Employment Law and lastly amended through Law 11/2020 concerning Job Creation Law (“Employment Law”). If an employee has an instruction to conduct work on Public Holiday, there must be consent and payment of overtime from the company (this excludes specific companies regulated by the Ministry of Employment).

In order to manage their human resources effectively, companies’ shall understand the schedule of Public Holidays and joint leave days in the upcoming 2023. Herewith is the list of Indonesia Public Holiday in 2023:

Based on the list of Indonesia’s Public Holidays above, we understand that there are a total of 16 (sixteen) Public Holidays in 2023, whereas 10 (ten) of them fall on working days (Monday until Friday). However, the aforementioned Public Holiday can be amended at any time based on the government decisions. In late 2022 or early 2023, the Government shall enact the official decree concerning Public Holiday.

Please also take note that the joint leave day as above can be amended at any time according to government decisions.

The companies or employers that employ workers on Public Holiday shall pay overtime to the workers accordingly. There is a certain provision in Government Regulation No. 35/2021 concerning Temporary Employment Agreement, Outsourcing, Working Hours and Breaks and Termination of Employment (“GR 35/2021”). The calculation of overtime pay shall be based on monthly wage. The method to calculate an hour’s wage is 1/173 (one per one hundred and seventy-three) times a month’s wages. Please find below the calculation of overtime pay:

 

Overtime in Public Holidays for Working Hour of 6 (Six) Working Days and 40 (Forty) Hours a Week Overtime in Public Holidays for Working Hour of 5 (Five) Working Days and 40 (Forty) Hours a Week
  • The first hour to the seventh hour is paid 2 (two) times an hour’s wage.
  • The eighth hour is paid 3 (three) times an hour’s wage.
  • The ninth hour, tenth hour, and eleventh hour are paid 4 (four) times an hour’s wage.

 

Additional notes for Public Holiday fall on the shortest business day, the calculation as below:

 

  • The first hour to the fifth hour is paid 2 (two) times an hour’s wage.
  • The sixth hour is paid 3 (three) times an hour’s wage.
  • The seventh hour, the eighth hour, and the ninth hour are paid 4 (four) times an hour’s wage.
  • The first hour to the eighth hour is paid 2 (two) times an hour’s wage.
  • The ninth hour is paid 3 (three) times an hour’s wage.
  • The tenth hour, eleventh hour, and twelfth hour are paid 4 (four) times an hour’s wage.

That being said, the aforementioned list of Indonesia’s Public Holiday and joint leave day in 2023 shall be noticed by all employers. There are sanctions regulated under Article 187 of Employment Law if a company does not comply with the following provisions on overtime in Public Holidays.
